1. Overview
a. The Jim’s Steakout 30th Anniversary Promotion
will begin on Monday, March 28, 2011 and will end at close of business
on Friday, December 31, 2011.
b. Each month throughout the year, Jim’s Steakout
will give away a grand-prize. The grand-prize for the current month
will be posted in the stores and on the website. Drawings will be
held within seven days of the last day of entries. The prize schedule
is as follows:
April Entries taken from March 28th through
May 1st
May Entries taken from May 2nd through May 29th
June Entries taken from May 30th through July 3rd
July Entries taken from July 4th through July 31st
August Entries taken from August 1st through August 28th
September Entries taken from August 29th through October
2nd
October Entries taken from October 3rd through October
30th
November Entries taken from October 31st through November
27th
December Entries taken from November 28th through December
31st
2. Eligibility
a. By entering, participants represent that they
are eligible, and agree to be bound by these rules and the decisions
of Jim’s Steakout and to release Jim’s Steakout, their
sponsors, subsidiaries, affiliates, officers and employees from
any and all liability for any injuries, losses, or damages of any
kind caused by any prize or resulting from acceptance, possession,
use, or misuse of any prize
b. Entrants must be legal New York State residents
who are 18 years of age or older.
c. Entrants must possess valid, government issued
photo identification.
d. Entrants must have lawful access to the Internet
and a valid e-mail address OR a valid, working telephone number.
e. Employees of Jim’s Steakout and their immediate
families are NOT eligible. Immediate family shall include spouse,
parents, children, siblings, grandparents and grandchildren.
f. Any person residing within the same household
as an employee is NOT eligible.
g. Jim’s Steakout affiliates, subsidiaries,
distributors, advertising and promotion agencies are NOT eligible.
h. Winners are not eligible to win future grand-prizes
during the Jim’s Steakout 30th Anniversary promotion.
i. Jim's Steakout reserves the right to terminate or modify terms
under the Rewards Card Program at any time, by posting notice on
this website no less than 2 weeks before enforcing or implementing
such changes.
3. How to Enter
a. To enter, fill out an entry blank inside any
one of the 10 Jim’s Steakout locations.
b. Entry blanks must be filled out legibly and
completely with the following information:
First and Last Name
Complete Address (house/apt number, street, city, state and
zip code)
A full e-mail address OR a valid, working telephone number
c. Only one entry, per person, per day. All multiple
daily entries will be removed from the ballot box.
4. Prizes
a. Prizes may or may not be redeemed for cash at
the sole discretion of Jim’s Steakout.
b. Prizes may or may not be substituted at the
sole discretion of Jim’s Steakout.
c. All winners are responsible for all local, county,
state, and federal taxes on prizes based on the value of the prizes
set forth in these rules.
d. Jim’s Steakout and its Sponsors reserve
the right to substitute a comparable prize of like or greater value,
including cash, for any prize, for any reason.
e. Odds of winning depend on the number of entries
received.
5. Entrants may
be disqualified at the sole discretion of Jim’s Steakout.
6. Notification
a. Winners will be randomly selected in a drawing
held within seven days of the last day of entries.
b. Only entrants using the official Jim’s
Steakout entry blank will be selected.
c. Winners will first be notified by Telephone.
If there is no answer an email will be sent
to the winner notifying them that they have 24 hours
to call the telephone number provided to claim their prize.
If there is an answering machine or voice
mail, an email will be sent to the winner notifying them that
they have 24 hours to call the telephone number provided to claim
their prize.
d. If the corporate office does not receive a response
within 24 hours, a certified letter will be sent to the address
listed on the entry form explaining to the winner that they have
3 days from the date they received the letter to call the telephone
number provided to claim their prize.
e. If after 3 days from the date the winner received
the letter or 7 days from the day the letter was sent, whichever
is longest, the winner fails to contact the provided telephone number,
that winner is rejected and a new winner is selected.
7. Claim a Prize
a. Prizes will not be delivered and must be picked
up at the location designated by Jim’s Steakout or its sponsor.
b. If the winner is unable or unwilling to pick-up
the prize in a reasonable amount of time determined by Jim’s
Steakout, an alternate name will be selected.
c. Jim’s Steakout is not responsible for notification
failures due to internet access problems, lost mail or other technology
failures.
d. Winners will receive a 1099 IRS Tax form for
the value of the prize.
e. Photo identification and a social security number
are required in order to collect the prize.
f. Payment of all federal, state and local taxes
are the sole responsibility of the winner.
g. Prizes are limited solely to those items explicitly
set forth herein and shall not include any and all other expenses,
incidentals or taxes that may arise out of the winner’s receipt
of this prize.
h. Prizes will be awarded as is, with no written
or express warranty.
i. Jim’s Steakout reserves the right to substitute
a prize of greater or equal value at its sole discretion.
8. Miscellaneous
a. By participating in the contest, the winner
or winners (traveling companion, if applicable) agree to have their
name, voice, or likeness used in any advertising or broadcasting
material relating to this contest without additional financial or
other compensation.
b. Jim’s Steakout reserves the right to modify
the contest rules and dates at any time for any reason.
c. By participating in this contest, you agree
to be bound by these contest rules, any modifications thereof, and
by all other rules imposed by Jim’s Steakout management.
d. If due to circumstances beyond the control of
Jim’s Steakout, any event associated with this contest or the
prize is delayed, rescheduled, postponed or cancelled, Jim’s
Steakout reserves the right, but not the obligation, to cancel or
modify the contest and shall not be required to award a substitute
prize.
e. Failure to comply with the contest rules may
result in a contestant's disqualification, at the sole discretion
of Jim’s Steakout.
f. Jim’s Steakout is not responsible for typographical
or other errors in the printing, the offering or the administration
of the contest or in the announcement of a prize.
g. Copies of the written contest rules and a list
of all winners can be obtained by sending a self-addressed stamped
envelope to Jim’s Steakout.
